These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User", "Customer", "you") and Drive With Driver when you access www.drivewithdriver.com, make a booking via WhatsApp, phone, online form, or use any of our car driver rental India services.

By proceeding with any booking or using our chauffeur service Agra, you acknowledge that you have read, understood, and fully agree to these Terms. If you do not agree, do not use our services or make any bookings.

1. Scope of Our Services & Intermediary Role

Drive With Driver operates as a technology-enabled intermediary platform that connects customers with verified, background-checked, licensed, and trained professional drivers. We do not own vehicles (except in limited partnered cab services) and are not the direct employer of drivers. Drivers provide services as independent contractors, using either your own vehicle or a partnered vehicle.

Our core services include:

• Hourly / daily hire driver Agra packages (2, 4, 8, 12, 24 hours)

• Outstation driver hire Uttar Pradesh with transparent km-based pricing
• Corporate chauffeur UP for business, executive, and official travel

2. User Eligibility & Responsibilities

You must be at least 18 years old and legally competent to enter into contracts to use our personal driver rental Agra services. You agree to provide accurate, complete, and current information during booking (name, contact number, pickup/drop locations, vehicle details if applicable).

As the customer, you are responsible for:

• Ensuring any vehicle used is legally registered, insured, roadworthy, and compliant with the Motor Vehicles Act
• Not instructing or allowing the driver to engage in illegal, unsafe, or unethical activities
• Making timely payment of all applicable charges
• Treating the driver with respect and complying with all traffic and safety regulations

3. Booking Process, Confirmation & Modifications

4. Pricing, Payment Terms & Extra Charges

5. Cancellation & Refund Rules

Free cancellation is allowed up to 2 hours before the scheduled pickup time for most hourly/local packages. Cancellations made within 2 hours attract a 50% charge; no-shows or last-minute cancellations incur 100% charge.

Refunds (where applicable) are processed to the original payment method within 7–10 working days. Outstation and multi-day bookings may have stricter cancellation policies — contact support for clarification.

6. Limitation of Liability & Disclaimers

While we provide verified drivers with valid licenses and background checks, Drive With Driver acts solely as a facilitator. We are not liable for:

• Delays due to traffic, breakdowns, weather, roadblocks, or force majeure events
• Loss of or damage to personal property, injury, or accidents (unless directly caused by proven gross negligence of the assigned driver)
• Any driver conduct outside our reasonable control (report issues immediately)

Our maximum liability in any case is limited to the total amount paid for the specific booking. You agree to indemnify and hold us harmless from claims arising from your misuse of the service or vehicle.

7. Driver Conduct, Safety & Compliance

All drivers are required to obey traffic laws, maintain professionalism, and ensure passenger safety. Any complaints regarding driver behavior must be reported immediately via WhatsApp or call. Validated complaints may result in driver replacement or blacklisting.

Customers must never request drivers to violate laws (e.g., overspeeding, carrying excess passengers). Such requests may lead to immediate termination of service without refund.

8. Force Majeure

Neither party shall be liable for non-performance caused by events beyond reasonable control, including natural disasters, pandemics, government restrictions, strikes, war, or civil unrest.

9. Governing Law & Jurisdiction
